    How LCWRA back pay works

If a Work Capability Assessment finds that you have limited capability for work and work-related activity (LCWRA), an extra monthly amount is added to your Universal Credit. It is often called the health element. The extra amount does not start on the day you are assessed. Under regulation 28 of the Universal Credit Regulations 2013 there is a relevant period of three months, starting on the day you first give evidence such as a fit note. LCWRA is then included from the start of the assessment period after the one in which those three months end.

If your assessment takes longer than those three months, some assessment periods will already have been paid without LCWRA by the time the decision arrives. Those months are owed to you as back pay, also called arrears. Until the decision, GOV.UK says you keep getting the standard allowance, or your existing amount if you reported a change.

    💡 Quick answer

Say your assessment periods start on the 15th and you sent your first fit note on 10 January 2026. The three months end on 9 April 2026, so LCWRA is due from the period starting 15 April 2026. With a decision on 20 September 2026, five periods have already been paid without it: 5 × £429.80 = £2,149.00 back pay, then £429.80 in each payment after that.

    LCWRA amounts by year

The monthly amount depends on when each assessment period starts. Each year's rates apply from the first assessment period that starts on or after the date in the up-rating order, so one period can straddle April and still use the old rate.

Sources: Social Security Benefits Up-rating Orders 2023, 2024, 2025 and 2026, the Universal Credit Act 2025 and SI 2026/113. Section 3 of the Universal Credit Act 2025 switches off the usual yearly up-rating of LCWRA for 2026/27 to 2029/30, and the 2026/27 amounts cover assessment periods starting before the first Monday of the next tax year, 12 April 2027. Amounts for later periods have not been published, so the calculator stops there. If you started a health-related claim before 3 April 2017 and have limited capability for work, an older element of £158.76 a month may apply instead. This calculator does not cover that.

    Which 2026/27 amount you get

From 6 April 2026 the Universal Credit Act 2025 split LCWRA into two rates. GOV.UK says you get the higher amount of £429.80 if any of these apply:

    • you told DWP about your health condition or disability before 6 April 2026, whatever the date of the LCWRA decision
    • you were already getting LCWRA before 6 April 2026
    • you had the support group component of income-related ESA before 6 April 2026 and kept it until you claimed Universal Credit
    • you have a severe, lifelong condition, or you are nearing the end of life

Otherwise the lower amount of £217.26 applies. You are treated as having a severe, lifelong condition if your condition means you cannot work, will last your whole life, will not get better and is officially diagnosed. If you and your partner both have LCWRA you get one amount, and it is the higher one if either of you qualifies. To keep the higher amount as a claimant from before 2026, your award must continue. A break caused by earnings that ends within six months does not count.

When there is no waiting period

    • Nearing the end of life. The three months do not apply. If you ask for a change and say you are terminally ill, the change takes effect from the first day of the assessment period in which you became terminally ill.
    • Moving from ESA. There is no waiting period if you are entitled to Employment and Support Allowance that includes the support component.
    • An earlier award. If a previous Universal Credit award included LCWRA and ended because you became or stopped being part of a couple, or ended because of earnings within the last six months, the waiting period does not start again.

    More worked examples

Lower amount. A new claimant sends a fit note on the day they claim, 3 May 2026. The three months end on 2 August 2026, so LCWRA is due from the period starting 3 August. A decision on 1 December 2026 leaves three periods unpaid: 3 × £217.26 = £651.78.

Across April. Periods start on the 20th and the first fit note was sent on 5 November 2025. The three months end on 4 February 2026, so LCWRA is due from 20 February. With a decision on 10 June 2026, the periods from 20 February and 20 March use the 2025/26 rate and the period from 20 April uses the 2026/27 higher amount: 2 × £423.27 + £429.80 = £1,276.34.

Other things that can add to your back pay

    • Work allowance. Having a health condition that affects your ability to work can give you a work allowance of £427 a month if you get help with housing costs, or £710 if not. If you work and had no work allowance before, your back pay can be higher than the LCWRA amount alone.
    • Benefit cap. The benefit cap does not apply if you or your partner get Universal Credit with LCWRA. If your payments were capped, that can also change.
    • Carer element. You cannot get the carer element and LCWRA at the same time, so a carer amount you had before may be replaced.
    • Earnings. If you earn over £881 a month, you might not get a Work Capability Assessment at all.

Getting your back pay and checking it

The regulations let DWP pay arrears outside your normal payment date. DWP can only split arrears into instalments if it thinks that protects you and you agree. Check that the award starts from the right assessment period and uses the right rate for each period. If you think the date or amount is wrong, you can usually ask for a mandatory reconsideration within one month of the decision. To see your whole award, try our Universal Credit calculator.

    Frequently asked questions

    Is LCWRA backdated?

Yes, but not to the day you claimed. LCWRA is included from the start of the assessment period after the one in which the three-month waiting period ends. The three months start on the day you first give evidence, such as a fit note. Months that were paid without it before your decision are owed as back pay.

How much is LCWRA a month in 2026/27?

It is £429.80 a month if you told DWP about your condition before 6 April 2026, already had LCWRA, have a severe lifelong condition or are nearing the end of life. For most people who report a condition on or after 6 April 2026 it is £217.26 a month. In 2025/26 it was £423.27.

I sent my first fit note before 6 April 2026 but my decision came later. Which rate do I get?

The higher amount of £429.80 for periods from April 2026. GOV.UK says the higher amount applies if you told DWP about your condition before 6 April 2026, whatever the date of the decision. Periods that started before 6 April 2026 are paid at the 2025/26 rate of £423.27.

When is LCWRA paid from if I am terminally ill?

There is no three-month waiting period. If you tell DWP you are terminally ill, the change takes effect from the first day of the assessment period in which you became terminally ill, and you get the higher amount.

Can LCWRA back pay be paid in instalments?

Only in limited cases. The regulations allow DWP to pay arrears in instalments if it thinks this is needed to protect your interests and you agree. Otherwise arrears are paid in full, and DWP can pay them outside your normal payment date.
